Jam Trainer Embed License Agreement

This Embed License Agreement (the “Agreement”) is between Jam Trainer LLC (“Jam Trainer,” “we,” “us”) and the person or organization we approve to embed the Jam Trainer player (“you”). It supplements our Terms of Service (the “Terms”); terms defined there have the same meaning here. If this Agreement and the Terms conflict on anything about embedding, this Agreement controls.

1. Getting permission

• Displaying a Jam Trainer chart or player inside any website, application, course, or membership platform other than jamtrainer.com (“embedding”) requires our prior written permission.
• To apply, email info@jamtrainer.com with your name or organization, the site or sites where you want to embed, and how you plan to use the player.
• Permission takes effect only when we confirm it in writing (email is enough) and enable embedding on your account. Our confirmation identifies the sites you may use (the “Approved Sites”). By placing embed code after approval, you accept this Agreement.
• Having access to an embed feature, or copying a link or embed code, is not permission to embed.

2. License

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, royalty-free license to display the Jam Trainer player on the Approved Sites, using the embed code we provide, for as long as this Agreement is in effect. You may use the player on a site that charges for access, such as a paid course or membership, but you may not charge for the player itself.

All rights not expressly granted are reserved. This license gives you no ownership of the Service, the player, its audio, or the Jam Trainer name or logo.

3. Restrictions

You may not:

• modify, wrap, crop, overlay, or obscure the player or the Jam Trainer name, logo, or links it displays;
• embed on any site other than an Approved Site, or let anyone else use your embed code;
• sell, rent, or charge separately for access to the player or its audio;
• download, record, capture, or redistribute the player's audio, except as the Service itself allows;
• use the player on a site that is unlawful, infringing, defamatory, or obscene, or in a way that implies we endorse you, your site, or your products;
• interfere with, overload, or circumvent any limit or security feature of the player; or
• use our name or logo other than as it appears in the player, without our permission.

4. Attribution

The player displays the Jam Trainer name and links to jamtrainer.com. That attribution is part of the consideration for this license and must remain visible and working. With your permission, we may identify you as an embed partner in our own marketing.

5. Content and licensing responsibility

• You are responsible for the charts you embed and for having the right to present them. Section 5 of the Terms applies to them.
• The Service is designed to remove lyrics, tab, notes, and links from a chart before it is embedded. Do not place that kind of material alongside the player unless you have the right to.
• You are responsible for obtaining any license your use requires, including public-performance, mechanical, or synchronization rights in the underlying musical compositions (Terms §5.3). We do not grant, and cannot grant, any right in a composition we do not own.

6. Privacy

When a visitor loads the player, their browser connects directly to Jam Trainer, and our Privacy Policy applies to what we process. You are responsible for your own site's privacy notices and for any consent your site requires. You may not use the player to collect information about the people who use it.

7. Changes to the player

We provide the player as-is. We may change, limit, or discontinue it, or change the embed code, at any time without notice, and we do not guarantee its availability or performance.

8. Fees

This license is currently free. If we introduce fees for embedding, we will give you at least 30 days' notice, and you may end this Agreement before any fee applies to you.

9. Term and termination

• This Agreement lasts until either of us ends it.
• You may end it at any time by removing the embed code and telling us.
• We may suspend or end it at any time, for any reason, including by disabling embedded players, with or without notice.
• When it ends, you must remove all Jam Trainer embed code from your sites within 14 days. Sections 3, 5, 10, and 11 survive.

10. Disclaimers, liability, and indemnity

• The Disclaimers (Terms §12) and Limitation of Liability (Terms §13) apply to the player. Our total liability under this Agreement will not exceed USD 100.
• You will indemnify and hold harmless Jam Trainer LLC and its owner from any claims, damages, and expenses (including reasonable legal fees) arising from your sites, your content, your use of the player, or your breach of this Agreement, including any claim that you lacked a license required by Section 5.

11. General

• Section 17 of the Terms (governing law and dispute resolution) applies to this Agreement.
• We may update this Agreement. We will notify you at the email address you used to apply, and continuing to embed after an update takes effect means you accept it.
• You may not assign this Agreement. We may assign it in connection with a merger, acquisition, or sale of assets.
• Notices to us go to info@jamtrainer.com. Notices to you go to the email address you used to apply.
